At the location set forth hereon, Florida Outboard Service, warrants to the original purchaser (hereafter the “customer”) that each rebuilt product sold hereunder shall be free from defects and materials in workmanship for the period set forth below from the date of delivery to the customer. If the product is found by Florida Outboard Service to be defective, such product will, at Florida Outboard Service’s sole option, be replaced or repaired at cost to Florida Outboard Service.
Florida Outboard Service’s liability (whether under the theories of breach of contract or warranty, negligence or strict liability) for its product shall be limited to repairing or replacing parts found by Florida Outboard Service to be defective. In no event shall Florida Outboard Service be liable for consequential, incidental or other damages arising out of or in connection with the product. Consequential damages shall include, without limitation, loss of use, income or profit, or losses sustained as the result of injury (including death) to any person, or loss of or damage to property.

All products alleged by the customer to be defective must be returned to Florida Outboard Service, postage paid. T he customer expressly agrees, at the customer’s expense, to return the warranted product to Florida Outboard Service’s place of business between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday, except legal holidays: 205 N Flagler Avenue Homestead, Florida 33030. In the event that Florida Outboard Service provides, as a courtesy to the customer, one or more free pickups or deliveries (or performs any work at any place other than the address listed above), the customer expressly agrees that such courtesy shall not constitute a waiver of the requirements of this part.
In the event Florida Outboard Service deems warranty service justified under the terms of this limited warranty, Florida Outboard Service shall have 45 working days from the date of actual delivery, not including the actual date of delivery of the defective or malfunctioning product to Florida Outboard Service’s place of business within which to provide said service and notify the customer of completion.
Limitation of Coverage
This limited warranty does not apply to any product which has been subject to misuse, mishandling, misapplication, racing use, rust or corrosion, neglect (including but not limited to improper maintenance or failure to follow break-in instructions), accident, modification (including but not limited to use of unauthorized parts or attachments), nor does this limited warranty extend to any otherwise covered product on which the manufacturer’s serial number has been defaced, altered or removed.
This limited warranty does not apply to any product which has been subject to adjustment or repair performed by anyone other than Florida Outboard Service, without prior written authority of Florida Outboard Service. Should the customer allow any adjustment or repair to be performed in violation of this provision, this limited warranty shall be deemed void, and Florida Outboard Service shall be released from any and all further liability hereunder.
This limited warranty does not cover normal wear or any damage to an otherwise covered product if the damage is the result of blockage in the fuel, oil, or cooling systems, water damage due to water entry through the carburetors, exhaust system, or is the result of submerÂsion, or rod or piston damage caused from high rpm running, i.e. connection rods snapped between the rod end and the wrist pin end, or pistons that have been damaged from cold seizure or damaged from preignition or detonation.
This limited warranty does not apply to any product for which the following break-in instructions are not followed (unless other written instructions are given by Florida Outboard Service to the customer upon original delivery of the product):
1) Rebuilt power heads shall not be operated in excess of 3,500 r.p.m. during the first 10 hours of operation and during the first 4-6 hours the power head must be run at idle speed only, not to exceed 1,500 r.p.m..
2) Only original manufacturer outboard oils (OMC, Mercury or Yamaha) shall be used in any product covered under this warranty with a rating of TCW III or higher.
3) During the first 10 hours of operation, all gasoline must be a minimum of 92.5 octane and must be double oiled (oiled to twice the manufacturer’s specifications).
4) During the first 10 hours of operation, the engine should not be run for more than 10 minutes at the same r.p.m., the r.p.m. instead being varied constantly for proper break-in.
5) All break-in instructions must be followed. They can be found in the break-in booklet. It will be furnished to you when your motor is returned.
This limited warranty covers engine block, cylinder heads, and moving parts inside the power head only, to wit: pistons, crank shaft, rods, bearing, wrist pins, and wrist pin bearings. This warranty does not cover any item not otherwise specified in this part unless specifically and expressly agreed to by Florida Outboard Service in a separate writing.
This limited warranty is for a period of 5 years from the date of delivery of the covered product to the customer. During the first year Florida Outboard Service shall repair or replace the covered product, at its option, without cost to the customer. During the 2nd year Florida Outboard Service shall be responsible for 75% of the expenses of all parts and labor of the repair or replacement, at its option, with the customer being responsible for 25%. During the 3rd and 4th years Florida Outboard Service shall be responsible for 50% of the expenses of all parts and labor of the repair or replacement, at its option, with the customer being responsible for the other half. The fifth year we will be responsible for 25% of all parts and labor of the repair or replacement, customer responsible for the rest.
The parties hereto expressly agree that the customer’s sole and exclusive remedy against Florida Outboard Service shall be for the repairs or replacement of the defective product as provided in this limited warranty.
This exclusive remedy shall not be deemed to have failed of its essential purpose so long as Florida Outboard Service is willing and able to repair or replace defective goods. This limited warranty is in lieu of all other warranties, express or implied, including those of merchantability or fitness for a particular purpose not expressly set forth herein.
